    Frequently Asked Questions

Considering mediation but have questions? Here are answers to what businesses and individuals commonly ask before getting started.

    Is mediation legally binding?
The mediation process itself is voluntary and non-binding until both parties reach an agreement. Once a settlement is reached and signed, it becomes a legally enforceable contract under the Mediation Act, 2023.
Do both parties need to agree to mediate?
Yes. Mediation is a consensual process — both parties must voluntarily agree to participate. However, either party can initiate the request, and our team will reach out to the other side to gauge willingness.
How long does mediation typically take?
Most mediations are resolved within 2–4 sessions, often concluding within a few weeks. This is significantly faster than arbitration or litigation, which can take months or years.
What types of disputes can be resolved through mediation?
Mediation is well-suited for commercial disputes, vendor and partnership disagreements, banking and loan settlements, workplace conflicts, and family or individual disputes. Criminal matters and certain statutory disputes are not eligible for mediation.
    What happens if mediation fails?
If parties are unable to reach a settlement, they retain the right to pursue arbitration or litigation. Nothing said during mediation can be used as evidence in subsequent proceedings, ensuring open and honest discussion.
    Can mediation be conducted online?
Yes. Through our VirtureResolve360 platform, mediation sessions — including joint meetings and private caucuses — can be conducted entirely online with end-to-end encryption and digital document sharing.
