    Frequently Asked Questions

Considering conciliation but have questions? Here are answers to what businesses and individuals commonly ask before getting started.

Is a conciliation agreement legally binding?
Yes. Once both parties sign the settlement agreement, it has the same legal status as an arbitral award on agreed terms and is final and binding under Section 73 & 74 of the Arbitration and Conciliation Act, 1996.
Do both parties need to agree to conciliate?
Yes. Conciliation is a consensual process — one party can invite the other to conciliate, but both must agree to participate for proceedings to begin.
How long does conciliation typically take?
Most matters are resolved within 1–3 sessions, often within a few weeks — making it one of the fastest routes to a binding settlement.
What types of disputes can be resolved through conciliation?
Conciliation is well-suited for banking and loan defaults, MSME payment disputes, commercial and contractual disagreements, and individual financial matters. Criminal matters and certain statutory disputes are not eligible.
    What happens if conciliation fails?
If parties are unable to reach a settlement, the conciliator terminates proceedings, and the matter can proceed to arbitration or litigation. Statements made during conciliation cannot be used as evidence in subsequent proceedings.
    Can conciliation be conducted online?
Yes. Through our VirtureResolve360 platform, conciliation sessions — including joint meetings, private caucuses, and document sharing — can be conducted entirely online with end-to-end encryption.
